Alina Habba, President Donald Trump’s former personal attorney, announced Monday she is stepping down as U.S. attorney for New Jersey, resigning after two courts found her appointment was unlawful.

Key Facts

Habba’s temporary status in the role expired in July, leading the Trump administration to keep her in place by appointing her as the second-in-command at the New Jersey office.

Habba said she is stepping down from her role as a result of a ruling from the Third Circuit Court of Appeals, which found last month that “only the first assistant in place at the time the vacancy arises automatically assumes the functions and duties of the office.”

Habba said she will serve as a senior adviser to Attorney General Pam Bondi, who said she was “saddened to accept” Habba’s resignation.

Bondi blasted the circuit court, saying its decision was “flawed” and that the Justice Department is confident the decision will be reversed.
