A week-long hearing over Charlie Kirk’s killing began Monday in Utah, with Kirk’s widow Erika Kirk and Donald Trump, Jr., sitting in court as prosecutors lay out their evidence against suspect Tyler Robinson and try to convince the court that Robinson should be tried for shooting Kirk.

Charlie Kirk’s family and widow Erika were present at Monday’s hearing, as were Trump Jr., a friend of Kirk’s, and right-wing commentator Jack Posobiec, multiple outlets reported.

The hearing got underway Monday with testimony from a law enforcement official who was present at the scene of Kirk’s killing, as well as a state investigator who led the investigation into the shooting.

Kirk’s parents and Erika Kirk left the courtroom as police officer Chris Bagley started directly speaking about Charlie Kirk being shot, multiple outlets report.

Prosecutors initially questioned Bagley about his experience being at Utah Valley University when Kirk was shot, including that he went to a rooftop where he knew there was a clear sight line to where Kirk was speaking, where he saw a screwdriver that looked out of place and a potential “sniper pad” where it appeared someone may have been lying to shoot a weapon.

Robinson’s attorney, while cross-examining Bagley, said, “Nothing that you found that day was able to identify who the shooter was?”

Robinson was arrested in September, days after Kirk was shot during an event at Utah Valley University, and has been charged with crimes including aggravated murder, which Robinson has not yet pleaded guilty or not guilty to.

What Happened At The Hearing Monday?

Bagley began his testimony by recounting the chaos after the shooting and his attempts to “preserve” the crime scene. Robinson’s lawyer cross-examined the police officer and asked questions to sow doubt about whether Robinson was actually the shooter, such as asking Bagley whether there was a possibility that anyone else could have been on the rooftop before he got up there and whether he was able to identify characteristics of Kirk’s shooter, such as his height. Kathryn Nester, Robinson’s attorney, also noted that Bagley’s body camera footage ended while he was on the roof, to which Bagley claimed the battery ran out and he was unable to get a new camera amid the post-shooting chaos. Investigator David Hull then testified about his experience leading the investigation, noting he was not familiar with Kirk or Utah Valley University before the shooting. Prosecutors used Hull to help authenticate videos of the shooting that they’re admitting into evidence, after the investigator processed public footage of the shooting and spoke with people who took the footage. Robinson’s attorneys also opposed video of Kirk’s killing being included as evidence in the case, arguing it could unfairly prejudice a jury against him at trial, but the judge ruled the video was admissible as evidence.

What to Watch for

The hearing will continue for the rest of the week, and prosecutors are expected to submit some 50 pieces of evidence in support of Robinson being Kirk’s killer. It’s still unclear when a ruling could come on whether a full trial will take place, and when Robinson could be tried if the court rules in prosecutors’ favor.

What Did Kirk’s Family Say?

Charlie Kirk’s family released a statement ahead of the hearing Monday, saying, “Every court proceeding serves as a painful reminder of his death and the loss that has irrevocably impacted our lives and the lives of his children.” The family expressed appreciation for the support they’ve received and said, “Out of respect for the judicial process, we will not be commenting further at this time. We ask for continued privacy as we navigate this process and immense grief.”

Kirk, who ran the right-wing organization Turning Point USA, was a major figure in the conservative movement before his September 2025 death, where he was shot while speaking at the university in Utah. Robinson was detained days later, after police released a photo of the suspect. Reports in the days after Robinson’s arrest suggest the suspect made comments online that appear to admit to Kirk’s killing, writing in a Discord chat, “It was me at UVU yesterday. im sorry for all of this.” Court documents also suggest Robinson texted his roommate and romantic partner, who is transgender, about the shooting after it happened, confessing to the killing and writing, “I had enough of his hatred. Some hate can’t be negotiated out.” Kirk’s shooting became a political flashpoint given the right-wing figure’s prominence, and the hearing to present evidence comes as a number of conspiracy theories have circulated about his death, including that Erika Kirk was somehow involved with the shooting, which she has denounced.
